Terms and Conditions of Sale and Payment

1. Introductory provision

Incorporated company ExperienCZE (Inc.) (Czech indetification number: 08750807, hereinafter „ExperienCZE“) is a travel maker and intermediary for tours, excursions, guides, babysitters, rental cars and other travel related services (thereinafter “services”) offered by its contractual partners – third parties (thereinafter “service providers”), for its clients through, among others, the websites www.experiencze.eu, www.experiencze.com, www.beer-bike.eu, www.pujcsi.eu including all language versions (thereinafter “website or websites”). Services available for purchase on the websites are provided by our partners and comprise a contract between the user and the service provider, not ExperienCZE. Although ExperienCZE uses greatest endeavors to ensure reputable suppliers are used on the websites, it accepts no liability arising from supplies by such partners.

2. Conclusion of a sales contract

a. ExperienCZE enables its clients to conclude a contract for the provision of services by third parties as well through its website and its booking department.

b. ExperienCZE serves as a travel intermediary for three types of services according to the contracting methods used:

I. Direct Services – services, for which the client can conclude a contract directly on our website direct from us (thereinafter “Direct Services”);

II. Indirect Services – services, which the client can select on our website and which terms and conditions of provision are specified by our Affiliate Partner (thereinafter “Indirect Services”);

III. Other Services – services, which the client specifies and agrees upon with ExperienCZE without the use of the website (thereinafter “Other Services”).

c. The contracting of Direct Services by the client from the service provider occurs in the following manner. The client selects the given services on the website and by clicking on “Book it!” he/she sends a request to ascertain the availability of the given service at the given dates. He will be contacted within 48 hours via e-mail by the ExperienCZE representative who will either confirm the given booking or not confirm it and offer an alternative service. If the client is not contacted within the aforementioned period, it is understood that the service is not available. The e-mail will include the period of validity of the offer, details about the payment and trade terms, and bank transfer details and instruction through which the client can pay for the service, which will include a description of the services and the final price of the services. The conclusion of a contract between the client and the service provider for the provision of the services specified in the offer occurs when the client pays the full amount of the booked services hrough our website or on the website of the service provider. If the payment is processed by ExperienCZE (not by the service provider) the client will receive a voucher confirming the conclusion and payment of the given contract within 48 hours following the conclusion of the contract.

d. The contracting of Indirect Services by the client from the service provider occurs when the client selects the given service on our website and pays for the selected services through the pages of our Affiliate Partner.

e. Contracts concerning Other Services are concluded between the client and the service provider directly through ExperienCZE. The contract is concluded when the ExperienCZE representative receives an e-mail or mail (U Skolky 12, 326 00 Pilsen, Czech Republic) from the client where the client provides expressed approval of the offer as prepared by ExperienCZE upon request from the client, and when the whole price or the agreed upon first deposit of the booked service is paid by the client. Direct contracts can also be concluded personally with the ExperienCZE representative either by verbal or written approval of the offer and by payment in cash.

 

3. Price and method of payment

The prices for the services as displayed on the website are indicated in EUR.

 

a. Payment by bank transfer

For payment please use a bank transfer. ExperienCZE provides the final price in  EUR  or in other  arranged currency in the offer sent to the customer as mentioned above. The amount in other currency will be determined by ExperienCZE and does not necessarily match the estimate price for the service as stated on the website. Payments in  EUR and CZK must be made on the hereafter indicated bank account at the bank Bank Fio (Account#: EUR: 28750807/2010 - IBAN: CZ80 2010 0000 0000 2875 0807 or CZK: 87508076/2010 - IBAN: CZ69 2010 0000 0000 8750 8076, SWIFT/BIC: FIOBCZPPXXX, Bank: Fio banka, a.s., V Celnici 1028/10, 117 21 Praha 1). Bank charges are shared by both parties, each party paying the charges of its own bank.

b. Cash payments

If indicated, some services can be paid by cash. ExperienCZE accepts cash payments in EUR or in other currency solely in case of direct contracts concluded personally with the ExperienCZE representative if agreed upon in advance. The amount that is withdrawn from the client following the conclusion of a contract is converted from EUR to other currencies by Czech National Bank exchange rate which is valid on the day of the payment.

c. VAT

Prices displayed on the websites are variable and include VAT (if applies).

 

4. Payment conditions

Unless otherwise stated, the client must pay for the booked services in advance, in the following manner:

The conclusion of the contract is conditioned by the payment of 100% of the total amount. For every booking ExperienCZE requires payment of the total amount at least 7 days prior to the realization of the booked service.

 

5. Handling and booking fees

ExperienCZE reserves the right to charge a handling fee on top of the total invoiced amount (to cover payment charges and bank charges). The amount of the fee is always announced prior to the payment. Handling fees are not refundable.

 

6. Withdrawal from the contract, cancellation fees and modification of the booked services

The client can withdraw completely or partially from the contract with the third party – service provider concluded through ExperienCZE without stating a reason, he will however be charged a cancellation fee as indicated below.

Notifications of complete or partial withdrawal from the contract (thereinafter withdrawal) must be made by the client in written form through e-mail or mail (U Skolky 12, 326 00 Pilsen, Czech Republic). The binding date to determine the amount of the cancellation fee is the date on which the withdrawal notification is delivered to U Skolky 12, 326 00 Pilsen, Czech Republic or the service provider. In case of cancellation the 2 following types of cancellation fees may apply:

I. Specific cancellation fees. If specific cancellation fees and policy apply for the particular service, it is always indicated on the websites. It will be always provided to the client prior to the payment.

II. Standard cancellation fees. If no specific cancellation fees are indicated, standard cancellation fees apply. In this case the following cancellation fees apply according to the type of services:

Tours, guides, instructors, fares, menus:

  • 100% of the total amount if the cancellation occurs after 12pm local time 2 days prior to the day when the service should start.
  • 50% of the total amount if the cancellation occurs after 12pm local time 5 to 3 days prior to the day when the service should start.
  • 10% of the total amount if the cancellation occurs after 12pm local time 6 to 7 days prior to the day when the service should start.
  • No cancellation fee applies if the cancellation occurs after 12pm local time 8 days and more prior to the day when the service should start.

 

Cultural events, sport events or admissions requiring a purchase of a nonrefundable ticket:

100% of the total amount for the service

Handling and booking fees (if apply) are not refundable.

 

7. Responsibility of ExperienCZE

a. ExperienCZE is not a party in the contractual relationship between the client and the service providers.

b. ExperienCZE is not responsible for any damage caused to the client in relation to the provision of services.

c. ExperienCZE does not guarantee the veracity and the completeness of the service description and only relies on the information that the service provider gave to ExperienCZE.

d. ExperienCZE guarantees neither that the services will be provided to the client nor that the services will be provided in the form as agreed between the client and the service providers booked through the website. ExperienCZE is not responsible for any breaking of the contract by the service provider. ExperienCZE is not compelled to provide alternative services to the client, if the services were not provided to the client by the third party according to the contract.

e. Any claims regarding the responsibility for damages relating to the services must be made by the client directly to the third parties providing these services. Upon request ExperienCZE will cooperate with the client to solve potential complaints.

f. ExperienCZE is neither responsible for the content of the offers from the third parties providing services on their website, nor for the potential violation of the rights of third parties, which these parties might commit through their offers (intellectual property rights, personal rights etc.).

g. ExperienCZE holds no responsibility as for the refund of the cost of the services paid through ExperienCZE to the service provider.

h. The provision of services can abide by general trade terms and conditions or by the specific terms and conditions of the service provider.

 

8. Final provision

a. These Terms and Conditions of Sale and Payment (thereinafter “TCSP”). as well as the relationship between the client and ExperienCZE conform to the law of the Czech Republic. By concluding a contract through ExperienCZE the client confirms that he is familiar with these TCSP and agrees with them.

b. The invalidity of individual provisions in the TCSP does not affect the validity of the remainder of the TCSP.

 

9. Privacy policy

a. Privacy policy in the Czech Republic is regulated by the Privacy Policy Act No 101/2000. In accordance to this Act the client gives ExperienCZE his consent for the use, the processing and the storage of his personal data, as gathered during the booking process. The Privacy policy is regulated by separate document which may be found here.

b. Under certain conditions ExperienCZE may transfer your personal data to the following third parties: the accommodation you booked, tour guides, tour operators, instructors, car rental companies or other service providers whose services you booked. For the purpose of completing your booking we will disclose your name, contact details and other relevant details to the relevant provider with which a booking is made. We will only provide those elements that are required for it to process your reservation.

 

These Terms and Conditions of Sale and Payment are valid as of March 15th, 2020.
